BBPS Pitampura derecognition withdrawn, HC asks DoE to hear school

Bal Bharati Public School (BBPS) Pitaampura on October 10 got a big relief after the Directorate of Education (DoE) of the Delhi government informed the Delhi High Court that it has withdrawn its derecognition order issued on August 16, 2021. “DOE is agreeable to withdraw the impugned orders dated August 16, 2021, and October 1, 2021, in the facts and circumstances of this case, and to grant a hearing to the School on the issues raised therein,” the government counsel told the court.

While disposing the writ petition (W.P.(C) 11544/2021), the Delhi High Court ordered that if the DOE wishes to take any action in respect of the derecognition of the School, it will issue a show-cause notice to the School, grant an opportunity of personal hearing, and then proceed to pass a fresh order.

It may be mentioned that by the first order dated 16.08.2021, the DOE had rejected the statement of fees submitted by the School for the year 2019- 2020, and gave various consequential directions. By the second impugned order dated October 1, 2021, the DOE has, in purported exercise of the powers conferred by Section 24(4) of the Delhi School Education Act, 1973 and Rules 43 and 56 of the Rules framed thereunder, withdrawn the derecognition granted to the School.

The order and withdrawal of the derecognition order have been welcomed across the spectrum by private schools. NISA (National Alliance of Private Schools)  had shown solidarity with BBPS and sent a letter to LG, Anil Baijal.
