HC directs JNV not to deny admission on previous schooling in another district

The Delhi High Court has directed Jawahar Navodaya Vidyalaya (JNV) not to deny admission to students based on their district of previous schooling. Justice C. Hari Shankar quashed a decision that denied a student admission to JNV Mungeshpur, stating the child is entitled to join Class 6 for the 2024-25 academic year.

This ruling came in response to a petition from a student who completed Class 5 at Navyug School in New Delhi and sought admission to JNV Mungeshpur. The school had denied her entry because she had not studied in the North West district where JNV Mungeshpur is located.

The court noted a similar case had been addressed previously, where an interim measure allowed the student to continue at JNV Mungeshpur. Justice Shankar emphasized that JNV must comply with this precedent and ensure students are not refused admission based on their district, without forcing them into litigation.

The decision to deny the petitioner was set aside, and the court ruled she is entitled to admission for the 2024-25 academic year, pending the outcome of an appeal before a division bench. The prior judgment deemed the exclusion of Central and New Delhi districts from JNV admissions arbitrary and in violation of Article 14 of the Constitution.
