UP: SC stays HC ruling for govt to create new list of 69K assistant teachers

The Supreme Court on Monday stayed the Allahabad High Court’s order requiring the Uttar Pradesh government to draft a new selection list for 69,000 assistant teachers.

The Court also suspended the High Court’s decision to invalidate the previous assistant teacher selection lists from June 2020 and January 2022, which included 6,800 candidates.

A bench led by Chief Justice D.Y. Chandrachud, alongside Justices J.B. Pardiwala and Manoj Misra, issued notices to the state government and other relevant parties, including the secretary of the UP Basic Education Board. The Court has requested written submissions from all parties involved, limited to seven pages, and scheduled a final hearing for the week starting September 23.

The High Court’s August directive had ordered the state to create a new selection list while mitigating any negative impact on current assistant teachers to avoid disrupting students’ education. The Court had also mandated that reserved category candidates who qualify for the general category should be included accordingly.

The High Court had previously canceled the January 2022 list of 6,800 reserved category candidates and required a new list to be issued within three months. The dispute centers on whether the reservation system and appointments were conducted correctly, with particular attention to the eligibility of candidates in the general category.
